Environmental Investigations
Liability imposed under existing environmental frameworks can be substantial, if not devastating. In addition to remediation and ongoing monitoring costs and compensatory damages for personal injuries, the potential is also real for fines and penalties and damaged relations with the public, target groups and shareholders.
iVision is prepared to impart its expertise in the context of litigation, including enforcement actions, compliance investigations and audits, environmental due diligence and a variety of internal matters, including but not limited to, on-site incidents and alleged wrongdoing relative to the collection, analysis and reporting of regulatory data governing facility discharges, plant operations and equipment efficiencies. Our experience has extended to:
‣ identifying participants and potentially responsible parties (PRPs)
‣ determining historical operational activities and procedures for the handling, storage and disposal of chemicals and waste products
‣ uncovering regulatory and public agency records, archived materials, prior relevant evidence from unrelated proceedings
‣ identifying and contacting potential witnesses
‣ developing impeachment material relative to key witnesses and experts
‣ tracing corporate histories to establish or defeat successor liability assertions
‣ establishing substantive facts in connection with a variety of claims, including but not limited to, diminution in property values, class status and certification and knowledge of key individuals
